Statement of risk and liability for Trips to the Maldives
Training & Education, Rental of Scuba Equipment & Supply of Breathing Gases, Guided & Organized Diving
This is a statement in which you are informed of the risks of skin and scuba diving and/or using diving equipment and breathing gases independently ofthe dive centre.
This statement also sets out the circumstances in which you can participate in diving courses/activities, organize and conduct scuba diving activities at your own risk and/or hire/supply of breathing gases.
Your signature is required as proof that you have read and understood this statement. If you do not understand anything contained in this statement, then please discuss it with the Dive Centre staff. If you are a minor, this form must also be read and signed by a parent or guardian.
1.Warning
Skin and scuba diving have inherent risks which may result in serious injury or death. Diving with mixed gases (Nitrox, Trimix, Heliox or Helair) involves certain inherent risks of oxygen toxicity and/or improper mixtures of breathing gas. Diving with compressed air or mixed gases involves certain inherent risks; decompression sickness, embolism or other hyperbaric injury can occur that requires treatment in a recompression chamber. Open Water diving trips which are necessary for training and certification, and Scuba diving trips, may be conducted at a site that is remote, either by time or distance or both, from such a recompression chamber. In the case of scuba equipment rental and breathing air supply, accident management remains your responsibility at all times. Skin and Scuba Diving are physically strenuous activities and you will be exerting yourself during these activities. You must advise truthfully and fully inform the instructor(s) and the Dive Centre of your medical history and of any change in your physical health during the diving activities.
2. Transportation to sites
Land and sea transport to dive sites may be provided by the Dive Centre. Using these facilities is at your own risk and the Dive Centre, its management and staff are not responsible for any loss, damage, or injury to yourself or your property.
3. Equipment
Prior to each dive you should be familiar with all the equipment supplied to you by the Dive Centre, and ensure that it is in good working order. If diving with mixed gases, it is your responsibility to ensure that the gases are correctly and accurately analyzed and that the gas content and cylinder number are recorded in such a manner as to be easily identified at any time. You should not offer the use of diving equipment (including cylinders and regulators) to other persons or entities under any circumstances.
4. Dive Planning and Personal Risk Assessment
Whilst the management and staff of the Dive Centre will suggest dive sites, conduct a risk assessment on the sites and brief qualified divers on guided and/or organized dives, it remains your responsibility to decide whether the dive is within your qualification and/or experience level, and whether to participate in the dive or not. It is also your responsibility to conduct a personal dive plan and equipment safety check with your diving partner. You must advise truthfully and fully inform the staff and the Dive Centre of your scuba diving certification and experience.
5. Exclusion of Liability
Notwithstanding the Dive Centre’s third party liability insurance covering diving activities, neither the Dive Centre, nor its owners, management, and instructors contracted by the Dive Centre or the training agency, accept any responsibility for the death, injury or other loss suffered or caused by you or resulting from your own conduct or any other matter or condition under your control. Your participation in courses, scuba diving activities and/or the rental of diving equipment, supply of breathing gases and scuba diving independent of the Dive Centre is at your own risk.
6. Jurisdiction and Applicable Law
As Family Divers LTD is Maltese company, any dispute or claim arising from the services or products offered by the company shall be subject to the jurisdiction of the courts of Malta and governed by the laws in force in Malta.
7. Signature and Acceptance
By ticking the checkbox stating “I have read and agree to the Statement of Risks and Liability of Family Divers Maldives” and by signing the form available at Family Divers Maldives Medical Form, I hereby acknowledge, confirm, and declare that I have carefully read, fully understood, and am entirely aware of all the key points, terms, conditions, risks, and liabilities set forth above, and that I voluntarily accept and agree to be bound by them.

Diving Expeditions and liveaboard trips Participant Agreement and Liability Waiver
Between: Family Divers Ltd, a company registered in Malta, with registered office at Imperial Court Blk A Fl 4, Triq ir-Ramel, San Pawl il-Bahar, SPB3035, Malta (hereinafter referred to as “FDL”)
And: The undersigned client (hereinafter referred to as “the Participant”)
1. Purpose of the Agreement:
This agreement governs the Participant’s involvement in expeditions organized by FDL, including travel services, accommodation, aquatic and land-based activities, and recreational scuba diving. By signing this document, the Participant declares to have read, understood, and accepted all terms and conditions set forth herein.
2. Included and Excluded Services:
2.1 Included:
- Accommodation as per itinerary
- Guided recreational dives
- Land or marine excursions (excluding entrance fees and guides, unless otherwise specified)
- Use of dive boats
- Basic scuba equipment (tanks, weights)
- Safety briefings and orientation sessions
2.2 Not Included:
- International or domestic flights
- Meals (unless otherwise specified)
- Unspecified transfers
- Medical, travel, or dive insurance
- Rental of additional equipment
- Gratuities, alcoholic beverages, personal expenses
- Government fees, visas, permits
3. Participant Requirements:
- Valid scuba diving certification (minimum Open Water; some expeditions may require Advanced level)
- Dive logbook
- Signed medical questionnaire
- Dive insurance covering medical evacuation and hyperbaric treatment
- Travel insurance covering cancellations and accidents
- Adequate physical condition
- Mandatory use of a personal dive computer
4. Conduct and Responsibility:
- Adherence to safe diving practices as per certifying agency standards
- Consumption of alcohol prior to diving is strictly prohibited
- Solo diving and decompression dives are not permitted
- Touching or feeding marine life is prohibited; the use of gloves is not allowed
5. Equipment and Vessels
- Rented equipment must be inspected by the Participant
- FDL does not guarantee the condition of third-party equipment
- The Participant shall be liable for any damage to or loss of equipment
- Boats may be operated by third parties; inherent risks are acknowledged and accepted
6. Disclaimer of Liability:
FDL may engage third-party service providers.
The Participant acknowledges that:
FDL shall not be held liable, directly or indirectly, for acts, omissions, negligence, recklessness, or contractual breaches by third-party providers, even when such providers have been recommended or arranged by FDL as part of the expedition.
The Participant assumes all risks associated with third-party activities.
7. Emergencies and Medical Treatment:
The Participant authorizes FDL to arrange medical treatment in the event of anemergency.
All related costs shall be borne by the Participant.
Complete insurance information must be provided.
8. Cancellations and Refunds:
By the Participant:
- An initial deposit of forty percent (40%) shall be paid via bank transfer and shall become non-refundable after forty-eight (48) hours from booking confirmation.
- The remaining sixty percent (60%) shall be paid via bank transfer no later than two (2) months prior to the expedition start date.
- Cancellations within sixty (60) days prior to departure may incur penalties:
- Sixty (60) days prior: 75% penalty of the total booking
- Thirty (30) days prior: 100% penalty of the total booking
By FDL:
- FDL may cancel or modify the expedition for justified reasons
- Rebooking or credit for future expeditions shall be offered
9. Data Protection:
Personal data collected under this agreement shall be processed in accordance with applicable Maltese legislation and used exclusively for the management of the expedition.
10. Jurisdiction:
This agreement shall be governed by the laws of Malta. Any dispute arising hereunder shall be submitted to the competent courts of Malta.
